Lead Poisoning Verdicts

1. Peguero Verdict
LPK Attorneys Alan J. Konigsberg and Daniel J. Woodard obtained a verdict totaling $6,900,000.00 on behalf of two brothers, ages 11 and 9, who were lead poisoned. For over 6 years, while residing in a Manhattan apartment building, the 11-year-old boy was exposed to peeling and chipping lead based paint and lead paint dust. The 9-year-old boy was exposed to the hazardous lead paint condition for over 4 years while residing in the same Manhattan apartment. The jury concluded that the owner of the apartment building was negligent in failing to maintain the apartment in accordance with the Laws of the State and that the infants’ lead poisoning was a substantial factor in causing their cognitive, intellectual and behavioral deficits. As a result of the lead poisoning, the infant plaintiffs' failed the first grade and continue to perform poorly academically. They also suffer from ADHD and other learning disabilities. The case was tried in New York State Court, New York County.

2. Lamont Stoves v. the City of New York (State Court)
LPK Attorneys Alan J. Konigsberg and Adam R. Cooper obtained a compensatory verdict totalling $3,850,000 on behalf of an 8-year-old boy who was lead poisoned for over 5 years while residing in an apartment owned by the City of New York. The jury concluded that the City was negligent in failing to maintain the apartment and that the infant's lead poisoning was a substantial factor in causing his cognitive and behavioral deficits. Tried in New York State Court, Kings County, 1999. This is one of the highest verdicts for childhood lead poisoning in the country. According to a report in the November 19 1999 edition of the New York Daily News, the verdict "was one of the costliest lead-poisoning verdicts ever against the city, legal experts said."

3. Jackson v. Chetram
LPK obtained a $3.39 million verdict for a 10 year old girl who was lead poisoned in a Brooklyn apartment building. Tried in Kings County in 2001, this was the third seven figure verdict achieved by LPK in a lead paint case in an 18 month period.
